Trusts

A trust is an agreement that allows the transfer of assets to a trustee.  There are many types of trusts, each with the ability to layout a detailed plan regarding your assets and how you would like them taken care of in the future.  Braggs Law Firm has over a decade of experience with all types of trusts including:

  • Revocable
  • Irrevocable Trusts
  • Special Needs Trusts

What is the difference between a trust and a will?

A trust differs from a will in a number of ways, one of the most noteworthy being that a trust is a private document, whereas a will is a public document.  Trusts remain confidential between the trustor and the trustee so the contents of the document do not become available to anyone else.

Do I need a trust?

Trusts are most often used when a person has property in multiple jurisdictions, children who are minors, or you would like a more detailed plan regarding the distribution of your assets.   In the writing of a trust, we can make specific plans regarding the timeline on which you want your assets distributed, special circumstances that would allow assets to be accessed by the trustee, and set up a plan that extends far into the future, potentially for multiple generations.

Creating a special needs trust.

Special Needs Trusts can be set up to ensure loved ones with special needs are cared for well into the future.   These types of trusts can be written to shield assets from impacting state and federal benefits while also creating allowances to provide the loved one with necessities.  Over the years, Braggs Law Firm has set up many Special Needs Trusts, helping ensure the best future possible for individuals with special needs all over DC and Northern Virginia.
