What is a guardian?

A guardian is a designated person who acts in the best interests of another person who is incapacitated, or unable to make decisions for him/herself.  Some guardians are appointed by the court, but this does not have to be the case.  Individuals can create a guardianship plan to have in place, should the need for a guardian arise.

What do guardians do?

When a person becomes incapacitated, a guardian is the person who makes decisions on behalf of the incapacitated person.  Because there can be many important decisions to make, the selection of the proper guardian is very important.  Guardians often have several very important decisions to make regarding health and wellness, living arrangements, and property.  Guardians are also required to maintain reports for the court and appear at any court proceedings.
